Hereinafter referred to as "Bleuforêt"

And

Any physical person visiting and/or wishing to make a purchase via the www.bleuforet.fr website.

Hereinafter referred to as the "Customer"

Hereinafter referred to collectively or individually as the "Party(ies)"

The website covered by these General Conditions of Sale is accessible via the URL www.bleuforet.fr (Hereinafter referred to as the "Website". The Website offers the Customer the opportunity to purchase Bleuforêt products, sold online by the company TRICOTAGE DES VOSGES (hereinafter referred to as "Products").

These General Conditions of Sale aim to define the terms of sale between Bleuforêt and the Customer with regard to distance selling, from order placement to payment and delivery (hereinafter referred to as the "General Conditions of Sale" or the "Contract"). They govern all of the stages necessary for the placement of the order and ensure the monitoring of this order by the contracting parties. The placement of an order implies irrevocable adherence to the General Conditions of Sale. The General Conditions of Sale may be subject to change, whereby the applicable conditions are those in force on the Website on the date the order is placed by the Customer.

The Customer declares:
- that he/she has the capacity to conclude the present Contract
- that he/she will not purchase products with the intention of re-sale
- that he/she is not a trader

3. Products

Any order implies acceptance of the prices and product description of the products available for sale. The Customer can, prior to placing his/her order, acquaint him/herself with the main product characteristics on the Website. The Products sold are described and presented with the greatest possible accuracy. If, in spite of all of our precautions, minor errors occur, and in the event of the receipt of a product that is not in keeping with that depicted on the Website, the Customer may exchange, return and/or request reimbursement in accordance with Article 9 of the General Conditions of Sale.
Our Product offers are available while stocks last. In the case that an order is placed for a Product that turns out to be unavailable, Bleuforêt, after informing the Customer, reserves the right to cancel the order.


4. Prices

All prices stated are in euros, inclusive of all tax, but not including delivery charges (see paragraph on Delivery).
Any change to the legal rate of VAT applicable will automatically be reflected in the price of the articles from the moment it comes into force.
Products are invoiced on the basis of the rates in force at the time the order is placed.
The Product prices stated on the Website are valid for the duration that the products are offered online.

The Product(s) shall remain the property of Bleuforêt until full receipt of payment by Bleuforêt. This price is payable in full and by means of a one-off payment.


5. Order

The Customer can place an order on the www.bleuforet.fr Website or via telephone, from Monday to Thursday between the hours of 08:00 and 12:00 and 13:00 and 17:30, or on Fridays between the hours of 08:00 and 12:00 and 13:00 and 17:00, at 03.29.23.45.45

The ordering process is as follows:
• Selection of products and addition to basket
• Validation of the content of the basket
• Verification of identification on the www.bleuforet.fr Website, if the customer has not already been identified
• Selection of delivery method
• Selection of means of payment and acceptance of the General Conditions of Sale
• Validation of the payment

No order can be taken into account until after receipt of payment.
The Customer will receive an order confirmation email.
At each of these various stages, the customer can view the details of his/her order and the total price for the order, and can correct any errors prior to confirming the order to express acceptance.
Bleuforêt reserves the right to cancel or refuse any order from a Customer with whom there exists a dispute regarding payment for a previous order.

6. Payment

Payment shall be made online by bank card (the accepted cards are Carte Bleue, Visa, Mastercard) or by Paypal account. The Customer also has the option to pay by cheque, although this applies only for sales in France. In this case, the cheque must be issued by a bank domiciled in mainland France or in Monaco.
The cheque will be cashed upon receipt.
The cheque must be sent to TRICOTAGE DES VOSGES S.A. 2, rue du Jumelage 88125 VAGNEY cedex.
Your order number, provided via email, must be stated on the reverse side of the cheque.
The delivery noted will be placed inside the package containing the ordered Product. Once an order has been placed, the Customer will have the option to print his/her invoice by logging onto the Website, and navigating to the order tracking area intended for this purpose.


7. Secure payment

In order to ensure secure payment, Bleuforêt uses the OGONE secure payment service.
This service incorporates the SSL3.0 security standard. (Confidential data is encrypted on the OGONE server and is at no point transmitted to the Bleuforêt computer server).
OGONE thus ensures the utmost level of data security concerning the Customer's means of payment.
The Customer's payment request is routed in real time to the OGONE secure remote payment system, which performs various verification checks to avoid abuse and fraud.


8. Delivery

Bleuforêt commits to deliver the Product within a maximum period of 30 days from the validation of the order.

With the exception of cases of force majeure, delivery periods will be as stated below, provided the item is in stock.

Any package with anomalies or that is open upon receipt by the Customer must be subject to a written reservation at the time of withdrawal and must be notified to the customer service on the same day.


8.1. In mainland France

Delivery charges and times:

Delivery by post - So Colissimo (Mainland France, Corsica, Monaco)
- Home delivery (€5.80), average delivery time of 2 to 3 working days
- Delivery to a point of withdrawal (post office, retailer or Cityssimo, €5.20), average delivery time of 2 to 3 working days

Express delivery by Chronopost (in mainland France only)
- Home delivery (€11.90), delivery within 24 hours if the order is placed prior to 13:00
- Delivery to a point of withdrawal (local retailer €8.90), delivery within 24 hours if the order is placed prior to 13:00


8.2. International

The delivery date is calculated taking into account the shipment processing time for the order, to which the delivery time for the carrier selected by the Customer is added.

In the event of a shipping delay, an email will be sent to the Customer.
In the event of a delay in delivery, the Customer has the option to cancel his/her order if the delivery has not been made within a period of 7 working days for deliveries in mainland France, or 10 working days for international deliveries.

9. Exchange, return and refund

Conditions of return:

From the date of receipt of the ordered Product, the Customer has a right of withdrawal for a period of 14 days.

The Customer can exercise his/her right of withdrawal, by submitting the standard withdrawal form (form can be downloaded here) or by means of any other clear and unambiguous declaration expressing his/her desire to withdraw.

The returned product must be unworn, unwashed, must still have its label, must be in its original packaging and, for items returned by post, accompanied by the withdrawal form or any other declaration of withdrawal, and with the delivery note enclosed.

The Customer must return the Product no later than 14 days following notification of the decision to withdraw.

Refund by means of a return to our factory

The Customer shall return the ordered Product or Products to Bleuforêt, by post, no later than 14 days following notification of the decision to withdraw, at the following address:

The Customer must enclose a copy of the electronic invoice when returning the Product (available via the Website, under "track your orders"), as well as the duly completed withdrawal form enclosed with the order (form can be downloaded here) or any other clear and unambiguous declaration expressing his/her desire to withdraw.

The charges for the return shall be covered by the Customer. Any initial delivery charges will only be refunded in full in the event that the entirety of the order is returned.
In the case of the partial return of an order, Bleuforêt shall reimburse the Customer for the amount of the shipping charges (outgoing) in proportion to the total amount of the order. In the case of the full return of an order, Bleuforêt shall reimburse the Customer for the total of the shipping charges paid when placing the order.
Furthermore, Bleuforêt is not obliged to reimburse additional fees if the Customer expressly selected a method of delivery that is more expensive than the standard delivery offered by Bleuforêt.

Upon receipt and inspection or the provision of proof of the shipping of the return, the Product or Products returned will be refunded within a period of 14 days, with the amount credited to the bank card or PayPal account that was used for the initial payment of the order.

10. Protection of personal data

Personal information


On account of personal information being required for the processing and delivery of orders, the drafting of invoices and in the battle against payment fraud, the collection of this information is mandatory within the context of distance selling. This information is strictly confidential and shall only be used by Bleuforêt.

In compliance with French Law no. 78-17 of 6 January 1978 relating to computing, files and liberties, the processing of personal information collected via the www.bleuforet.fr Website has been the subject of an NS 48 declaration to the CNIL (French National Commission on Information Technology and Liberties). The user has the right to access, modify, correct and delete data relating to him/her. To exercise this right, the Customer must send a letter to the following address:

The Customer is hereby informed that Bleuforêt makes use of cookies.


11. Intellectual property

All elements of the Website, whether visual or audible, including the underlying technology, are protected by copyright, trademarks or patents. Likewise, the trademarks, logos, designs and templates featured on the Website are the exclusive property of Bleuforêt. Their disclosure can under no circumstances be interpreted as granting you any licence or right whatsoever to use said trademarks and distinctive elements, which are protected by copyright. They therefore cannot be used, under pain of infringement of copyright.
Thus, none of the documents from the Website can be copied, reproduced, republished, downloaded, posted, transmitted or distributed in any way whatsoever.
However, it is possible to download a copy of the documents onto a computer for your own personal use and only for non-commercial purposes, on the condition that the user does not modify the information contained therein and that all copyrights and mentions of ownership remain intact. The modification of these documents, or there use for another purpose shall constitute a breach of Bleuforêt's intellectual property rights.

Any Customer operating his/her own Website and who wishes, for personal use, to place a simple link on his/her website leading directly to the homepage of the Website, must request authorisation from Bleuforêt. This will in no way imply an affiliation contract.
However, all hypertext links directing to the Website and that use the technique of framing or in-line linking are strictly prohibited. In any case, any link, even if tacitly authorised, must be removed upon simple request by Bleuforêt.


12. Prohibition on resale

Any order placed by a Customer is intended for his/her personal use or the personal use of the person to whom the order is sent.
The Customer is prohibited from reselling Products purchased on the Website.
Order deemed to be abnormal on account of their volume or frequency will be refused by Bleuforêt.


13 Liability

Bleuforêt's obligations relating to the stages relating to the accessing of the Website, the ordering process, delivery or the after-sales services are strictly a matter of exercising due care. Bleuforêt cannot be held responsible for any inconvenience or damages inherent to the use of the Internet network, in particular for a disruption to service, external intrusion or the presence of computer viruses, or for any event deemed to fall under force majeure, in accordance with the law. Furthermore, Bleuforêt shall not be liable for any breach of its contractual obligations in cases of force majeure or unforeseeable circumstances, including but not limited to strike action, fire, disasters, breakdowns and, more generally, any event that prevents the proper fulfilment of orders.


14. Applicable law

The present Contract is subject to French law. The language of the present Contract is French.
In the event of a dispute, the French courts shall have sole jurisdiction, subject to the jurisdiction-related options at the disposal of Customers located outside of France.
